INTRODUCTION

These terms and conditions outline the rules and regulations for the use of our photography and videography services. By booking our services, you accept these terms and conditions in full. If you disagree with any part of these terms, please refrain from using our services.

These terms are effective as of 2nd of February 2025.

SERVICES

Photography Services: We offer a range of photography services including, but not limited to portraits, events, and commercial photography.

Videography Services: Our videography services cover events, promotional videos, and other personal or commercial projects.

Service Area: Our photography and videography services are available exclusively in Colchester and surrounding areas. For events outside of this region, please contact us to discuss availability and any additional travel fees.

BOOKING AND PAYMENT

1. Booking Confirmation: A booking is considered confirmed only upon receipt of a signed contract and a non-refundable deposit, which is a percentage of the total service cost.

2. Payment Terms: The remaining balance is due prior to or on the day of the booking. Payment can be made via bank transfer, credit card, or other agreed methods.

3. Cancellation and Refunds: Cancellations must be made in writing. The deposit is non-refundable. Cancellations made less than 48 hours before the booking may incur additional charges.

DELIVERABLES

1. Photographs and Videos: High-resolution digital files will be delivered within 1-2 weeks for photographs and 2-3 weeks for videos. rush delivery options are available upon request.

2. Editing and Retouching: Basic editing is included. Additional retouching requests may incur extra charges.

3. Delivery Method: Final products will be delivered through an online gallery, or via USB drive, depending on client preference.

CLIENT RESPONSIBILITIES

1. Access and Safety: The client must ensure safe and reasonable access to the event venue for our team.

2. Permissions: It is the client’s responsibility to secure any necessary permits or permissions for photography and videography at the chosen location.

COPYRIGHT AND USAGE

1. Copyright: All photographs and videos remain the property of Shot by Tyo. Clients are granted a license for personal use.

2. Commercial Use: For commercial use, additional licensing agreements must be established.

3. Portfolio Use: We reserve the right to use images and videos for our portfolio, website, and marketing materials unless the client requests otherwise in writing.

4. Client Sharing and Attribution: When sharing images/videos on social media or other platforms, clients must provide proper attribution to our business (e.g., tagging our social media handle).

5. Editing Restrictions: Clients are not permitted to edit or alter the photographs/videos without prior consent from Shot by Tyo.

6. Third-Party Usage: Clients may not share or distribute the photographs/videos to third parties for commercial purposes without obtaining the appropriate license.

LIABILITY

1. Equipment Failure or Accidents: We take great care in our work, but in the unlikely event of equipment failure or accidents, our liability is limited to the refund of payments received.

2. Acts of Nature: We are not liable for delays or cancellations due to acts of nature or other unforeseen circumstances.

PRIVACY POLICY

We are committed to protecting your privacy. Personal information collected during the booking process will be used solely for the purpose of providing our services and will not be shared with third parties without consent.

Data Retention: Client data will be retained for 1-2 years after the final product delivery, unless otherwise requested by the client.

AMENDMENTS

We may update these terms and conditions from time to time. Updated terms will be communicated to clients and published on our website.
